Financial Ratings of Insurance Companies
I have found that many insurance companies will tout their financial credibility through the rating companies scoring. You will see AM Best ratings, Moody's ratings, or Standard and Poor's ratings throughout company paraphernalia. The common ingredient seems to be that you cannot compare the two. One company may tout their AM Best rating, while another company you are looking at touts their Moody rating. I believe this is intentional because the rating companies will use different criteria in their scoring, and it is an obvious decision to use the 'best' insurance rating score to promote each insurance company to insurance shoppers.
Financial ratings are important for insurance shoppers. Generally they educate the shopper about the financial wherewithal of each company. This would imply a verification of the companies ability to pay claims to you in the event of a disaster. So what do you do to compare companies financial strengths?
I don't pretend to know the inner workings of the insurance industry, the ad industry or the ratings industry; however, I would suggest that companies that are intertwined with each other are not too critical of each other. If one company gets consistently high ratings from a given rating company but not so high from the others, I tend to believe there is some nepotism going on in the relationship and the scoring the insurance company promotes.
I have found a rating company called Weiss Ratings, that professes to be independent of the insurance companies because they accept no money from the companies they rate. I feel fortunate to have found them from The Street website.
I have found some interesting results in their scoring. If you have read my previous articles you have found that I am not a proponent of "big" insurance companies over "small" insurance companies, but rather a proponent of education. For the insurance shopper to make an informed decision it is important to understand that there are independent ratings of satisfaction, claims service, financial strength, and other factors that are important for insurance shoppers. I discussed previously that the winner of JD Power's recent "customer satisfaction with claims" award was a company most insurance consumers had probably never heard of, now if you run a Weiss Rating of financial strength the same company is financially strong too. In England, insurance was first established in the late 17th century. But before that time, there are "friendly societies" existed in England. Each member donated amounts of money to a general sum that could be used for emergencies. Near the end of the 17th century, London's growing importance as a centre for trade increased demand for marine insurance. While in the United States, In 1752, the Philadelphia Contributionship for the Insurance of Houses from Loss by Fire became the first mutual fire insurance company in America.

Insurance Fraud 1: Faked Death
Insurance fraud is a crime being committed every day. All over the world, some sinister people believed insurance money are free money which can be picked at will through their concoction of a plan. While some of the perpetrators are caught, some escaped with the compensation undetected. But no matter what, crime doesn't pay. In whatever form, either big or small, a crime is a crime and a criminal is a criminal.
This is a real life story of one of the highest life insurance crime ever perpetrated.
Sunn-ke (not the real name) was an Asian beautician by profession. She was around 28 years old, married with 2 children; she had a biological mother who was 49 years old. One day, an insurance salesman came up to Sunn-ke and advised her about Insurance. Based on this, she took an Endowment Life Assurance worth of one million dollars for her mother and half the amount for herself. Then, she continued paying the premium on a monthly basis.
After two years of paying the premiums regularly, she concocted a trick on how she could dupe the insurer of the sum assured.
First, she took her mother out of the country under a false identity to her uncle in United States of America. Then, she came back and announced to the people that her mum had died. What baffled everybody was that she placed an obituary in the popular newspaper and got a death certificate on behalf of her mother's death. She then took all this to her insurer.
The people at the insurance company were surprised at this occurrence. They sent some people to visit and console Sunn-ke's family but on getting there, they met the house door locked and upon enquiring from the neighbours, they were surprised when they tried to condole with the neighbours and were met with scornful eyes. When they asked one of the neighbours when the woman died, he said he had no idea of the woman's death and that he saw the woman went out with the daughter, dressed in a travelling mood, and she never came back to the house.
This piece of information got the insurance people suspicious. Then, they sent two of their special investigators to unravel the matter. The insurance investigators went to the Sunn-ke's mother's village. On getting there, the interviewed elders were surprised at the news of the woman and they told them that they were just hearing of it. The whole village was immediately thrown into a state of mourning.
The insurance investigators, on getting back, asked Sunn-ke where her mother's corpse was and when she told them that she had been buried, they asked her why she had to do that without informing the village elders of the woman's death. She replied them that it was her mother's last request that she should be buried immediately she died as she would not want any native rite performed on her dead body. However, when they asked her to take them to the burial site, she told them that she wouldn't be able to do that right away and gave them an appointment for the third day.
Some people are so desperate and, evil begets evil, likes begets likes. A dubious action is a chain networking which one crime perpetrated has to be covered up with another criminal action, which in turn needs to be protected from being discovered and has to be covered up with another dubious action, and so on and so forth.
The moment Sunn-ke discovered that her trick was about to be investigated to the core, she went to the burial site and arranged with some people working there. What they did was to get a fresh female corpse of the right age and buried it, after which they arranged for a decent tombstone to be erected on the grave. All this was done in the dead of night to avoid any prying witness.
On the third day, the investigators went with Sunn-ke to verify the burial point of her mother. They noticed a freshly-prepared tomb, when they commented on this Sunn-ke told them that she just did that because she just had sufficient fund to do it.
Whatever is worth doing is worth doing well. The insurance investigators gave their report to their office in which they suggested in exhuming the corpse for final verification. True to the point, they got permission from the appropriate authority and exhumed the corpse and saw the decaying corpse. But what disturbed the investigation was that they could not do any form of identification such as facial, dental etc. Why? The corpse was already decaying beyond the point of recognition and the local woman never visited a dentist for any dental problem; so there was no dental history.
Since it has been verified that the woman was dead by exhuming the body, the insurance had no choice except to pay the complete compensation of sum assured to the woman.
After the compensation had been paid, the top management body of the insurance organization held a meeting and gave the two insurance investigators the mandate to continue their investigation until they were fully satisfied.
Right now, Sunn-ke was at peace of mind that her plot had succeeded without knowing that her phones, shop and house had been electronically bugged by the insurance investigators to eavesdrop on her conversations.
The first breakthrough was when she phoned her uncle in the United States of America. While talking to her uncle, she asked about her mum.
About three days after, she went to a phone booth and discussed with a distant caller. This, after checking through, was discovered to be the same number she used to call her uncle in United States of America. This led to greater suspicion on this case. Why did she had to go and call outside by using public telephone booth and refuse to use her phones? Who is she calling to? What is the content of the conversation?
The next thing the insurance investigators did was to bug all the public telephones within the vicinity of the one Sunn-ke used the other time. Luck was on their side because she made the same long distance call again within a week of this bugging by using the same phone booth and they were able to record the conversation and discovered that the person at the other end was her mother - the supposed dead woman whose assurance sum-assured had been paid.
The insurance investigators gave the full report to the management - all the recorded conversations, the traced address in USA where Sunn-ke was making telephone call to her mother.
The situation turned to an international crime because Sunn-ke's uncle had a hand in the affairs; he was the one who cooked up the plot right from the beginning before they took the insurance policy. All of them had to be rounded up and dealt with according to the law.
However, the woman never knew the type of game she was being used for by her biological daughter. Neither did she know that she had been proclaimed dead nor had any knowledge that a tombstone had been erected on her behalf while she was still alive and kicking.
This is the extent to which some dark-hearted people can go for money's sake. Insurance organisations lose billions of dollars annually through insurance fraud. Some people had turned it into some kind of game in duping insurance organizations, they always believed that they can go scot-free but most of them are usually caught in the end no matter how near-perfect the plot may be.

ACORD Certificates of Insurance - What Certificate Holders and Providers Need to Know
The Certificate and Evidence of Insurance forms which ACORD made effective in late 2009/early 2010 have raised alarm among insurance certificate holders and the insureds that must provide them. Unless insurers issue manuscript endorsements to their policies (which is unlikely), insurers no longer make any pledge that they will even attempt to notify most certificate holders if the policies are cancelled. The new certificate forms have eliminated the assurance that the insurer would "endeavor to mail __ days written notice to the certificate holder." They simply state that "...should any of the above described policies be cancelled before the expiration date thereof, notice will be delivered in accordance with the policy provisions."
What does that mean to certificate holders under standard insurance policies?
Liability and auto - Even if a certificate holder is an additional insured, it will not be notified if the policy is cancelled. Only the First Named Insured will be notified.
Workers compensation - Certificate holders will not be notified of cancellation, since the policy requires the insurance company to notify only the covered employer.
Property - Mortgagees and loss payees on standard property policies will be notified - 10 days before the insurer cancels for nonpayment, 30 days before it cancels for any other reason and 10 days before it nonrenews the policy (unless modified by state requirements). Other certificate holders, even additional insureds, will not be notified.
All policies - Certificate holders, even additional insureds, will not be notified if the insured itself cancels the policy.
How should insurance requirements in contracts be changed in order to respond?
Contract language requiring insurance certificates to state that "__ days notice of cancellation be given" and requiring that the "endeavor to" language in the certificate be deleted, is no longer applicable. Even if changes are made to the certificate, ACORD has made it exceedingly clear that changes to the certificate do not change the policy.
The contract should require that the insured party provide immediate notice to the owner, lessor, etc. if the insured entity receives notice of cancellation or nonrenewal from its insurer. This provision is especially important since many insurers will not be willing to comply with the recommendations below, especially for smaller insureds. Unfortunately, this has the obvious drawback of depending on the very party who is non-performing to report the non-performance.
Contracts should require that the insured's policies be endorsed to meet the certificate holder's reasonable requirements. (However, as stated above, not all insurers will be willing to cooperate.) If the insurer is somewhat cooperative, it may be willing to extending the same notification rights to the certificate holder that it gives to the first Named Insured. Below is sample manuscript endorsement wording that would accomplish that end. Very large insureds may be able to obtain even broader notification rights.
"If we cancel or elect not to renew this policy, we will give written notice to ____________ at the following address __________________. We will provide the same notice of cancellation and nonrenewal that is required by this policy to the first Named Insured."
So if the certificate holder is given the same notice of cancellation and nonrenewal as the first Named Insured, what does that actually mean with standard policies?
Standard commercial insurance policies provide the first Named Insured with 10 days notice of cancellation for nonpayment of premium. If the insurer cancels mid-term for any reason besides non-payment of premium, commercial general liability, automobile and property policies provide 30 days notice of cancellation. Workers compensation policies, however, provide only 10 days notice of mid-term cancellation. If an insurer nonrenews a policy versus cancelling it mid-term, it may nonrenew a commercial automobile or workers compensation policy without any advance notice at all. Property policies may also be nonrenewed without any advance notice to the insured, but if there is a mortgagee or loss payee on the policy, they must be given at least 10 days advance notice. General liability policies may be nonrenewed with just 30 days notice.
State laws in most states change the above requirements, requiring more notice in many situations. For instance, Florida requires that carriers provide the first Named Insured with 45 days notice of cancellation in some circumstances. The provisions of the different state laws are often complicated, differing not only by line of coverage but also by length of time the policy has been in force, the specific reasons for the cancellation or nonrenewal, etc. The specific state requirements can be accessed through the IRMI Insurance Cancellation Guide published by the International Risk Management Institute.
The larger the insured client, the more likely that it will be able to obtain additional concessions from its insurer. If possible, those additional provisions should require:
Advance notice to the certificate holder even if the insured initiates the cancellation or nonrenewal andMinimum cancellation and nonrenewal provisions, regardless of what is provided by the standard policies or various state laws.
Why not just require the old form?
You may ask, "Why doesn't the certificate holder simply require the insured and its insurance agent to provide the old certificate of insurance form?" What certificate holders and insureds should know is that if an agent does modify a standard certificate or signs a custom one that provides notice of cancellation, it is almost certainly doing so against the explicit direction of the insurance company. So while the certificate holder may have a paper in its hand which states that the insurance company will provide notice of cancellation, the insurer will not stand behind it. If coverage is cancelled, all that the certificate holder has probably gained is the right to sue the agent and its errors and omissions carrier. Since the agent is probably executing the modified certificate with the full knowledge that it is not authorized to do so, coverage under its errors and omissions policy is suspect. Vendor solutions
I am aware of about 20 different vendors who provide some form of insurance certificate and verification service. I have found only one vendor that provides a certificate service that completely bypasses ACORD certificates and their problems. I pass on their information as a service to readers. Their name is Ins-Cert Corporation, and information on their services can be found by doing an Internet search under that name. Their system is Web-based and requires the agent/broker to agree to make a "good faith effort" to enter notices of cancellation into their system. The system then automatically sends cancellation notices to all certificate holders by email. Their system appears to offer a solution to both the problem of cancellation notices and also the problem of fraudulent ACORD certificates. From my investigation I believe they offer a legitimate service and are worthy of consideration. Readers of this paper who have found other workable solutions to this problem are asked to contact me.
Why the "Good Ol' Days" Weren't Really So Good -
Certificate holders certainly wish that the insurance industry would find a way to notify them when an insurance policy is cancelled. But in reality, they may not have lost much in this change besides the illusion that the insurer would notify them.
Many insureds have a "blanket additional insured" endorsement on their liability policies. That means that anyone that the insured agrees to name as an additional insured in a contract is automatically given that status in its insurance policy. But that also means that the insurance company does not obtain the names and addresses of those additional insureds, so the insurer does not know who they are or how to notify them.
Certificate holders would reasonably assume that as a matter of good faith, insurers would require that the agents/brokers send them a list of all of the certificates that they issued so that the insurer could "endeavor" to give notice of cancellation. Incredibly, that is not the case. Many carriers have explicitly told the agents/brokers not to send them copies of the certificates.
Since many insurance carriers have not made the good faith effort to comply with the notice requirements of the old certificate forms, not much is lost by eliminating the notice requirements altogether. At least false promises are no longer being made.
Closing thought
In writing about these changes on its own Website ACORD explained that it had to change its certificates because they sometimes contradicted or expanded the duties contained in the underlying insurance policies. Unfortunately, they were not able to cooperate with the other players in the insurance industry (the insurance companies, ISO and NCCI) to craft a solution which solved that problem while also meeting the legitimate business need of certificate holders to receive a cancellation notice. The outcry from the business community may need to get much louder before a better solution to this problem is reached.

How Much Insurance Is Enough?
I cannot calculate the number of times I heard this question. Oftentimes it resulted in a good conversation about insurance and what it does for you.
I am a firm believer that the importance of this question lies in an interest to protect oneself from a 'worst case' incident. What is the worst case? For a homeowner, how about an accidental drowning at a birthday party? Maybe a driver swerves to avoid a dog, loses control and hits a pedestrian instead. Both tragic. Both carry the potential of substantial loss to the insured.
Follow along with this simple exercise to aid in finding a comfortable protection limit. Imagine a treasure chest sitting next to you. In that treasure chest imagine your valuables inside. Think about your money and savings held in the bank or credit union. $1000, $2000, $10000, or $100,000. That floats in there. Imagine your stocks, bonds, and mutual funds. $10,000, $50,000, $100,000 or more. Float that in there too. Don't forget to float the equity in your home (s) and or rental properties. For some this number alone can be substantial. Put your equity in the treasure chest too. How about your possessions? What would it cost to fill your house or apartment again? Retirement accounts have many different factors, they can be ERISA protected, or non-ERISA protected. A non-ERISA account can be subject to garnishment in certain cases. To properly protect your retirement balances you should review your protections with both your insurance agent and an attorney.
A notorious example of lack of protection, and protection of assets, was the OJ Simpson civil trial. When his case was closed, he lost everything from the clothes in his closet to the money in his bank. The reason he is living comfortably in Florida is most likely an ERISA protected retirement plan.
This exercise is a good tool for both the 'do it yourself' insurance shopper, and the 'agent oriented' insurance shopper. When going it alone you have a basis for a coverage decision, and when working with an agent you have some points to start your conversation.
